School Year Calendar & Waivers
1) The BOE requested a waiver of four days from the State Board. Waivers are not automatic by any means, and the declaration of “state of emergency” is not a factor. The decision will be made by the state Superintendent. Hopefully CCPS will get an answer early next week. EACC will meet with the Superintendent once we know what MSDE’s response is; the Board’s course of action – and EACC’s response to it — both depend on a decision that hasn’t been made yet. THAT SAID –
2) If the waiver is NOT granted, then per the calendar, schools will be open four days during Spring Break. This will make up the four student days as well as the four teacher/employee work days. At this point, EACC would take action to enforce the contract Article 12 pertaining to the planning time on early dismissal days, which were turned into instructional days in the Superintendent’s waiver request.
3) If the waiver IS granted, 4 days will be taken off the student year. Teachers are still under contract for 189 days (209 days for 11-month; 225 for 12-month staff) and could be asked to work them. How those are scheduled would be worked out with the EACC and the Superintendent. Both Spring Break and the end of June are possibilities legally, though the Superintendent’s posture suggests the end of June is more likely. EACC and the BOE have the ability to modify the contract by mutual consent – for example we could agree to forgo the early dismissal planning days and concurrently reduce the employee work year.
4) As of this time, the last teacher work day with a waiver of four days would be Wednesday, June 18th, the same last day as for students. If four days were not waived and instead added to the calendar at the end of the year, the last 10-month day would be Tuesday June 24th; in this case, the 11-month and 12-month employees would not work two weeks beyond the 10-month employees because any days worked subsequent to July 1 count towards the total for FY 2015.
